Questions about RERA compensation
Is this compensation guaranteed?
The RERA Act gives you a legal right to claim interest for delayed possession. However, the final amount awarded depends on the RERA authority's order. Our calculator gives you an accurate estimate based on the statutory rate. Most homebuyers who file get close to the estimated amount.
What is the 10.85% interest rate based on?
Under RERA Section 18, the interest rate is linked to SBI's Marginal Cost of Funds Based Lending Rate (MCLR). Most states use SBI 3-year MCLR + 2% = 10.80% per annum (effective Jan 2026). Some states differ: Uttar Pradesh uses MCLR + 1% (9.80%), while Andhra Pradesh and Chhattisgarh use SBI's older Prime Lending Rate + 2% (~16.65%). Our calculator applies the correct rate for your state automatically.
Do I need a lawyer to file a RERA complaint?
No. RERA was specifically designed so homebuyers can file complaints themselves without a lawyer. The process is online, through your state's RERA portal. Our filing guide walks you through every step. Many homebuyers have successfully recovered compensation without legal representation.
How long does a RERA case take?
RERA authorities are mandated to dispose of complaints within 60 days. In practice, most cases are resolved within 60–120 days. This is significantly faster than civil courts (which can take years). Once an order is passed, builders typically comply or face further penalties.
What if my project is not RERA registered?
If your project was launched after RERA came into force (May 2017) and is above 500 sq metres or has more than 8 apartments, it must be RERA registered. Builders who sold without registering have actually violated RERA and face higher penalties. Our letter covers this scenario — you can still file a complaint and claim compensation plus penalties.
Can I claim for the full amount even if I paid in instalments?
Yes. The interest is calculated on the actual amounts paid and from the dates they were paid, not on the total agreement value. Our calculator accounts for this — if you've paid ₹40L out of a ₹60L flat, your compensation is on the ₹40L actually paid.
